U.S. auto dealers take over Obama fuel rules fight (Reuters)

WASHINGTON (Reuters) ? U.S. auto dealers are working to undo the Obama administration's fuel efficiency agenda, replacing car companies that for years kept such mandates at bay with the help of allies in Congress.

The car industry is facing dramatic new standards that would double efficiency targets to 54 miles per gallon by 2025, under an administration plan unveiled in July and set to be officially proposed in the coming weeks.

Automakers have traditionally carried the torch for modest fuel efficiency mandates, arguing that aggressive targets could drive up vehicle cost, compromise safety, and limit consumer choice.

But car executives agreed to the ambitious targets during negotiations this spring, going along with an administration that rescued the U.S. industry from collapse in 2009. General Motors and Chrysler owe their continued existence to Obama, and taxpayers still own a third of GM.

Virtually all big automakers reluctantly agreed to the 2025 deal in the talks led by the White House, leaving dealers on their own to fight the new standards.

"This is a big jump, and we'd like to slow this process down and find out what's working and what's not," said Dave Westcott, who operates two North Carolina showrooms and is an executive with a trade group behind the delay effort. "We'd like the public to be in control of what they would like."

Dealers are backing a Republican measure that would remove the influence of federal environmental regulators and the state of California in establishing national mileage standards.

Dealers are also weighing a lawsuit if legislative efforts tied to a spending bill in the Republican-controlled House of Representatives fail. So far, there is no companion proposal in the Senate, which is led by Democrats who are aligned with Obama on the issue.

President Barack Obama has championed higher auto fuel efficiency as the single most important step the United States can take to reduce its dependence on foreign oil. It will also cut emissions of greenhouse gases.

Environmental groups have appealed to the National Automobile Dealers Association to drop their objections, pointing out that a number of carmakers offer exceptionally efficient vehicles that are also popular with consumers.

PRICE-SENSITIVE CONSUMERS

Fuel economy politics have become more complicated with the recent introduction of the Environmental Protection Agency in federal rulemaking. California is an additional complication, with its desire to set its own regulations in its huge market.

Dealers want to return to when the Department of Transportation alone set fuel targets. For 30 years the standards went up incrementally, if at all, due mainly to the political muscle of automakers.

Auto dealers believe the recent White House agreement -- which they were excluded from -- bullies business and consumers.

They and other industry insiders complain it exceeds a reasonable embrace of hybrid and electric-engine technologies that have been slow to catch on with average car buyers.

Hybrids make up less than 3 percent of the overall U.S. sales market. And first-year sales of electric and mostly electric cars only made up only 0.12 percent of the 9.4 million cars and trucks sold overall through September of this year.

Jeremy Anwyl, chief executive of buyer research group Edmunds.com, said the gradual improvement in fuel efficiency standards over the past decade enabled carmakers to introduce hybrids and other technologies while maintaining quality.

He said the accelerated standards risk a repeat of quality and reliability problems in the late 1970s and early 1980s when environmental and safety regulations converged on the industry.

Dealers also complain that the higher costs of new technology will suppress sales as the struggling economy makes buyers more price sensitive.

For the 2012-2016 standards finalized last year, that culminate in an average fleet efficiency of 35 mpg, regulators estimate an average cost increase to consumers of $950.

"With the economy now, customers are so price sensitive," said Forrest McConnell, who owns Honda and Acura franchises in Alabama. "There is no problem with going up (in mpg) but it's a balancing act."

A White House spokesman, asked to comment for this story, did not address dealer complaints specifically, but said the that negotiated agreement underpinning the new fuel rules had the support of more than a dozen U.S. and overseas automakers.

BIG-DOLLAR DONATIONS

Dealers are embedded in their communities, are significant employers, and are barometers of economic health on the local level. They also represent the biggest source of campaign cash within the transportation industry, according to the Center for Responsive Politics.

The National Automobile Dealers Association ranks No. 19 overall on the CRP's list of "heavy hitter" contributors.

Dealers gave $2.6 million to candidates and political committees in the 2010 election cycle and historically favor Republicans. Donations for the 2012 campaign cycle have gone to Republicans by a 2 to 1 margin.

House Speaker John Boehner spoke to the dealers' association last month in Washington after which hundreds of members accelerated their lobbying. Rank and file Republicans also support efforts to upend fuel rules.

More than 60 members of the House wrote to Appropriations Committee Chairman Harold Rogers and Interior and Environment Subcommittee Chairman Michael Simpson last week supporting the legislative initiative.

The amendment to spending legislation would affect EPA's ability to work on fuel economy through September 2012, the end of the current fiscal year.

Such a strategy, if it becomes law, could kill the new regulation if Obama loses reelection to a Republican candidate inclined to drop the effort. Otherwise, high visibility pressure keeps the issue in the spotlight with the rule proposal under consideration.

Bailey Wood, the legislative affairs chief of the dealer group representing nearly 17,000 showrooms, said membership would concentrate for now on getting the House measure passed.

It was a passengers' nightmare at Bradley International Airport near Hartford, Conn., this weekend.

Passengers on at least three JetBlue planes and one American Airline plane say they were stranded on the tarmac for seven hours or more after being diverted from New York-area airports on Saturday.

The ordeal continued after they were let off and had to spend the night on cots and chairs in terminals.

A passenger on one of the diverted JetBlue planes says the crew ran out of snacks and bottled water for the last few hours of the delay.

"The toilets were backed up. When you flushed, nothing would happen," said Andrew Carter, a reporter for the Sun Sentinel of Florida, who was traveling to cover the Miami Dolphins game against the New York Giants. His plane took off from Fort Lauderdale for Newark Liberty International Airport at around 9 a.m. After being diverted to Hartford, the plane sat on the tarmac between around 1:30 p.m. and 9 p.m., he said.

A representative for Bradley International wasn't available to comment on the scope of the tarmac delays at the airport.

A JetBlue spokeswoman, Victoria Lucia, confirmed in an emailed statement that six of its planes, carrying a total of about 700 passengers, were diverted to Hartford as a result of a "confluence of events" including equipment failures at Newark and New York's John F. Kennedy International Airport that prevented planes from landing in low visibility.

She declined to specify how long the planes sat on the tarmac at Bradley, but noted that 17 other flights with different carriers were also diverted to airport.

Once the planes landed at Bradley, Lucia said that intermittent power outages at the airport made refueling and deplaning difficult.

Kate Hanni, executive editor for FlyersRights.org, said she got calls and emails from passengers and worried family members regarding at least four flights that were stranded on the tarmac for up to 10 hours.

Brent Stanley and his wife were on one of those planes, an American Airlines flight that had originally been headed to JFK after taking off from Charles de Gaulle airport in Paris.

After being diverted and landing in Hartford at 2:30 p.m., Stanley said passengers were given various reasons for being held on the tarmac, including the need to refuel and de-ice and the airport's limited capacity for handling international flights. He and his wife were eager to get back home to their two young sons in Lake Zurich, Ill. But they realized they didn't have it as bad as the parents who had infants on the plane.

"There was a lady in front of us with an 18-month-old daughter," Stanley said. "Another woman came by to borrow diapers because we couldn't get to our luggage."

After spending the night at the airport, Stanley was lucky to find two seats Sunday on an afternoon flight home to Chicago. But the headache isn't over yet; his luggage was headed to JFK because the Hartford airport crew wasn't able to handle international luggage, he said.

An American Airlines spokesman, Ed Martelle, said the passengers weren't allowed off the plane by customs at the airport. Martelle did not know the exact number of American planes that were diverted to Bradley or how long they sat on the tarmac.

Matt Shellenberger, who was on a JetBlue flight from Boston to JFK, said his plane was diverted to Bradley International and sat on the tarmac for seven hours.

The crew picked up trash regularly and handed out water and snacks and "everyone held their cool," he said. But his frustrations grew with each status update; the reasons for the delay kept changing as the hours passed.

Early on, passengers were told that the plane was just being refueled and would fly out soon, Shellenberger said. Then they were told it was being de-iced. Then there was an emergency on another plane.

"We were told we were the third plane in line to get to the gate when we landed," he said. "Then we stayed on the plane for seven hours."

Carter of the Sun Sentinel, who was on another JetBlue flight, reported a similar sequence of updates.

The saga continued long after passengers were let off the plane.

The power outages from storms throughout Connecticut made booking hotel rooms difficult. As a result, many passengers just slept at the airport, Carter and Shellenberger said in separate interviews.

When they awoke, hundreds of passengers had to wait in line for hours just to figure out which flight they'd be on.

"That was most disappointing part," Carter said. "It seemed like there was no plan when we got off the plane."

In the morning, Carter said he and several other passengers rented a van to drive to New Jersey rather than wait for the afternoon flight JetBlue had scheduled to Newark.

It's not the first time JetBlue has had problems with tarmac delays. The New York-based airline also made headlines in 2007 when snow and ice storms stranded its planes for nearly 11 hours at New York's John F. Kennedy International Airport.

Such high-profile delays helped prompt a regulation last year that fines airlines for holding domestic flights on the tarmac for more than three hours. This year, the rule was extended to apply to international flights that are held on the tarmac for more than four hours.

The Department of Transportation often doesn't enforce the fines to their full extent unless delays are extreme, however. Passengers also do not get a cut of the fines.

Low-cost carriers are more prone to tarmac delays because letting passengers off planes can cost an airline a lot of money, said Hanni of FlyersRights.org.

If a plane is diverted because of a reason within the airline's control, such as a mechanical failure, ticket contracts usually state that passengers will be reimbursed for hotels, food and transportation. That means airlines do everything in their power to keep passengers on board in hope that the plane will be able to take off again.

JetBlue said that passengers who were diverted to Bradley International would be reimbursed for their fares and hotel expenses.

A representative for the Port Authority of New York & New Jersey, which oversees Newark and JFK airports, could not immediately say how many total flights were diverted to other airports because of equipment failures.

Phoenix flight attendant found dead in Mexico City

(AP) ? A US Airways flight attendant based in Phoenix was found dead in a Mexico City hotel room while on a layover, and authorities are investigating the death as a homicide.

A flight attendants union said the body of Nick Aaronson, 33, was found early Saturday in his room at a downtown Hilton.

The Mexico City prosecutor's office said the man was found naked on the floor, his hands tied behind his back with a cloth. He showed signs of beating and choking.

Prosecutors said no drugs, weapons or messages were found in the room. Police were checking security cameras, and an autopsy was planned.

Deborah Volpe, president of the Association of Flight Attendants Council 66, said Aaronson was "very popular" and "very loved" among the airline's Phoenix-based crews.

"It's tragic," Volpe told The Arizona Republic (http://bit.ly/vYzlAl). "We are caring for our co-workers. We're a tight-knit group in Phoenix."

A statement on the union's website says there doesn't appear to be a safety breach at the hotel but that crews will stay elsewhere temporarily while on layovers.

The News and Record of Greensboro reports that authorities removed the felines from Carolyn Johnson's home after receiving complaints. The Rockingham County Animal Shelter says many of the animals were sick and had to be euthanized.

Johnson says the animals were being treated well, and that she was trying to save them from being put to sleep in shelters.

Four years ago, more than 100 cats were taken from Johnson's home under similar circumstances.

Kimberly Alboum of the state Humane Society says spay and neuter laws need to be changed to make such situations less common.

Dialectical Behavior Therapy (DBT), created in the early 1990s by psychologist Marsha Linehan, is one of the newer psychotherapies being used to treat a variety of emotional problems. Similar to Cognitive Behavior Therapy (CBT), which has been used successfully for many years to treat emotional problems including self-esteem issues, DBT adds to this the concepts of mindfulness and acceptance.

Mindfulness is a way of living your life so that you are in the present moment more often, with awareness, and with acceptance. Acceptance in this context doesn't mean that you approve of your experience, but that you simply acknowledge your present experience without judging it.

So what does this have to do with self-esteem? Everything! Just stop for a moment and think about this: How often do you really think about what you're thinking about? Have you ever had someone ask you what you were thinking about, and you had no idea? We're often completely oblivious to what we're thinking and feeling; and when we are aware of these things, we're often judging these internal experiences. Self-talk has a big impact on how you feel, and when you judge yourself or beat yourself up, it triggers painful emotions like anger, anxiety, disappointment and sadness; and it lowers your self-esteem.

Consider these questions to help you think about how you talk to yourself:

  • When you make a mistake, do you tend to judge yourself for it (e.g. "That was stupid," "I'm such an idiot")?
  • Do you think you are "your own worst critic," as the saying goes?
  • Does it sometimes feel like you have a tape-recorder running in your head, playing the same messages over and over again? For example: "I'm worthless," "I'm stupid," "How could anyone ever love me?"
  • When considering a new challenge, do you find yourself filled with self-doubt? For example: "I'll never be able to do this," "I'm not good enough," "Who am I kidding?"

Many people experience these kinds of thoughts so automatically that it's difficult for them to be aware of when these thoughts are present. In fact, in CBT these thoughts are actually referred to as "automatic thoughts." In spite of this lack of awareness of your thoughts, though, they still trigger painful emotions for you, making you feel bad about yourself and reducing your self-esteem.

This is where the DBT skills of mindfulness and acceptance come in: first, through mindfulness, you increase your awareness of these judgmental thoughts and the resulting emotions. Then you work on bringing acceptance to your experience -- accepting the thoughts as just thoughts; accepting the emotions they trigger; and gradually, accepting yourself as you are.

There are other DBT skills that help build self-esteem as well, such as:

  • Self-soothing skills help you improve your ability to take care of yourself through activities that help you to relax and feel calmer,
  • Building mastery helps you increase things you do that help you to feel productive and good about yourself for what you've accomplished, and
  • Interpersonal effectiveness skills help you learn to be more effective in relationships, including how to communicate more assertively, which helps you to feel better about yourself.

Of course, learning these skills and practicing them on your own isn't easy. Some people are able to do this with self-help books, but others need to work with a psychotherapist. Either way, the DBT skills are flexible and can be used to help with self-esteem issues, other emotional problems and simply to help you live a healthier, happier life.

TOKYO (Reuters) ? Japan's two newest stars have all the basics of being a pop idol down. Their dance moves are sharp, they sing without missing a beat, and their songs have made the top 10.

The only thing is, neither one of them exists.

The green-haired "Megpoid" and red-haired "Akikoloid" are both completely computer generated, the latest in a line of popular digital characters based on a voice-synthesizing program that allows users to create their own music.

They were the stars of a concert during the recent Digital Concept Expo in Tokyo.

Music made by "Vocaloid," the voice-synthesizing program, and its spin-off characters, has made it into the top 10 on Japan's weekly top hits list. But for those watching the concert, the performance was nothing more than thin air -- unless they looked at the screen showing the augmented reality (AR) scene with the 3D characters inserted into live video.

The software used at the concert used a complicated system of sensors and motion capture technology to create the two singers, with sensors around the venue and on the cameras and the hands of two human back dancers interacting to make a composite that was inserted into the concert in real time.

Nothing about the singers is real. Even their high, perky voices are digitally generated, but sound no different from those of many a live Japanese pop singer.

"Though there have been a few concerts with the characters before, this is the first time they could interact with others, including the audience, and appear to move around in a true 3D space," said Masaru Ishikawa, a Tokyo University researcher who helped create the system used for the concert.

"These sorts of concerts up to now have looked 3D but were actually using 2D technology. This is a world first in that the character is actually 3D and can sing and dance with others," he said.

Fans were able to get in on the action by using poles with markers that allowed them to be detected by the augmented reality system and interact with the characters by waving the poles around during the concert. Depending on the song, these movements produced stars, sparkles and flames in the video.

"Seeing the concert with augmented reality made it seem like they were really there, even though they weren't," 24-year-old fan Keisuke Shindo said after watching the hour-long concert.

"It was also interesting to see how they added the effects and allowed the audience to interact using the poles. I think it's pretty amazing."

In addition to the 150 fans at the actual concert, more than 65,000 people watched on Nico Nico Douga, a Japanese video-sharing site similar to YouTube.

NEW YORK (Reuters) ? Cheniere Energy has signed an $8 billion landmark deal with BG Group to ship U.S. natural gas across the globe, in the first export agreement of its kind from the lower 48 states, the company said Wednesday.

Under the deal, which could help reverse the fortunes of the troubled Houston-based company, Cheniere will sell 3.5 million tonnes per year of liquefied natural gas to BG for 20 years from its proposed export plant in Sabine Pass Louisiana, maybe as early as 2015.

It paves the way for Cheniere to secure financing for the project which could be the first LNG export plant built in the United States in nearly 50 years.

"If we start construction by next year then we could be exporting by 2015," Charif Souki told Reuters. "The BG Group contract will help with financing."

The deal is expected to reap $410 million a year, Souki said, a boon for a company which put most of its money into building a huge import terminal that has for three years received only sporadic supply.

Record U.S. natural gas production has swamped the market in recent years, leading to a series of rival export proposals all hoping to sell LNG to higher paying markets in Asia and Europe.

LNG is natural gas cooled to a liquid for shipping overseas.

Review: `In Time' is slick but repetitive sci-fi (AP)

With "In Time," writer-director Andrew Niccol takes a clever, compelling idea ? that time is currency and you can buy your way to immortality or die broke ? and beats it into the ground.

For a movie about the importance of maximizing every second, "In Time" ultimately grows repetitive and wears out its welcome. It's fast-paced and hugely stylish, though, with its great-looking cast and a mix of gleaming, futuristic visuals and grimy, industrial chic. And it's a welcome return to the kind of slick sci-fi Niccol made his name on in the mid-'90s with "Gattaca" and "The Truman Show" (which he wrote).

But his high-concept premise raises several nagging questions. Why do all the inhabitants of this dystopian world (which happens to look just like downtown Los Angeles and Century City) stop aging at 25, then find themselves with only a year left unless they can buy themselves more? When did this start ? what is the purpose? And if Justin Timberlake is so busy working in a factory just so he can afford to live one day to the next, where does he find time to go to the gym?

Yes, among the beautifully photographed images in "In Time" ? the work of the great cinematographer Roger Deakins ? is a shirtless Timberlake, early and often. He stars as Will Salas, who lives in the ghetto neighborhood of Dayton but dreams of moving to the ritzy New Greenwich with his mother (Olivia Wilde in an amusing bit of casting, since she's three years younger than Timberlake). In one of many inspired details, the amount of time you have glows green as it ticks away on your forearm, and you can share what you have ? or take it away ? by clasping wrists with another person.

When Will can't stop his mother's time from running out ? and he's framed for a crime he didn't commit ? he goes on a revenge spree to steal years from the rich and give them back to the poor. His accomplice: Sylvia Weis (Amanda Seyfried), the beautiful but sheltered daughter of the wealthiest man in town (Vincent Kartheiser), who starts out as his hostage but becomes his enthusiastic partner in crime.

So if you're keeping track, this is "Logan's Run" meets "Bonnie and Clyde" meets "Robin Hood."

Cillian Murphy is on their tail as a "timekeeper," a sort of cop who runs around enforcing the rampant theft of hours and minutes in his ever-present, distressed leather coat. Alex Pettyfer is also after them as a pimped-out British gangster (or "Minute Man") who wants to steal the hundreds of years these two have amassed.

Basically, everyone is gorgeous, high-cheekboned and fashionably dressed in the future, the last of which is the work of multiple Oscar-winning costume designer Colleen Atwood. Seyfried's style would please Anna Wintour ? because she happens to look just like the Vogue magazine editor ? with her dark red, blunt-cut bob and tailored, feminine designs. The downside of that, though, is that she has to run in heels ? a lot. A ridiculous amount, actually. She and Timberlake are cute and playful together, yet lack the kind of intense chemistry that suggests they'd ever be truly dangerous.

But if you can get past the plot holes and the copious time puns ? with phrases like "Have you got a minute?" and "You're taking forever" taking on a whole new meaning ? "In Time" is actually rather brisk, enjoyable entertainment. And with its gaping disparity between the haves and the have-nots causing increasing class tension, it also has the added benefit of being relevant.

"In Time," a 20th Century Fox release, is rated PG-13 for violence, some sexuality and partial nudity, and brief strong language. Running time: 109 minutes. Two and a half stars out of four.

Drinking More Fluids Could Lower Men's Bladder Cancer Risk (HealthDay)

TUESDAY, Oct. 25 (HealthDay News) -- Men who drink plenty of low-sugar fluids may reduce their risk for bladder cancer, new research suggests.

Although the reason for the association between fluid intake and protection against cancer remains unknown, researchers theorize the fluids may flush out potential cancer-causing agents before they have a chance to cause any damage.

In conducting the study, Jiachen Zhou, a doctoral candidate in epidemiology at Brown University, and colleagues evaluated the fluid intake of nearly 48,000 men who were part of a long-term study. The men, who were aged 40 to 75 when they enrolled in the study in 1986, answered a questionnaire about their fluid intake every four years for more than two decades.

The investigators found that the men with a high daily fluid intake, or those who drank more than 10 cups (2,531 milliliters) per day, had a 24 percent reduced risk for bladder cancer. The study authors concluded that doctors should tell their patients to drink plenty of low-sugar fluids.

Although this link between fluid intake and bladder cancer risk was discovered 10 years ago, the association, the study found, was stronger among younger men. This could be due to the fact that the men drank less as they aged, particularly water, the researchers pointed out in a news release from the American Association for Cancer Research.

The study findings -- which revealed an association between fluid consumption and reduced cancer risk, but not a cause-and-effect -- were slated for presentation Oct. 24 at the AACR International Conference on Frontiers in Cancer Prevention Research, in Boston. Research presented at medical meetings should be viewed as preliminary until published in a peer-reviewed journal.

SANAA, Yemen (AP) ? Hundreds of Yemeni women on Wednesday set fire to traditional female veils to protest the government's brutal crackdown against the country's popular uprising, as overnight clashes in the capital and another city killed 25 people, officials said.

In the capital Sanaa, the women spread a black cloth across a main street and threw their full-body veils, known as makrama, onto a pile, sprayed it with oil and set it ablaze. As the flames rose, they chanted: "Who protects Yemeni women from the crimes of the thugs?"

The women in Yemen have taken a key role in the uprising against President Ali Abdullah Saleh's authoritarian rule that erupted in March, inspired by other Arab revolutions. Their role came into the limelight earlier in October, when Yemeni woman activist Tawakkul Karman was awarded the Nobel Peace Prize, along with two Liberian women, for their struggle for women's rights.

Wednesday's protest, however, was not related to women's rights or issues surrounding the Islamic veils ? rather, the act of women burning their clothing is a symbolic Bedouin tribal gesture signifying an appeal for help to tribesmen, in this case to stop the attacks on the protesters.

The women who burned clothing in the capital were wearing traditional veils at the time, many covered in black from head to toe.

The women's protest came as clashes have intensified between Saleh's forces and renegade fighters who have sided with the protesters and the opposition in demands that the president step down.

Medical and local officials said up to 25 civilians, tribal fighters and government soldiers died overnight in Sanaa and the city of Taiz despite a cease-fire announcement by Saleh late Tuesday. Scores of others were wounded.

A medical official said seven tribal fighters were among those killed in Sanaa's Hassaba district. Another medical official said four residents and nine soldiers also died in the fighting there.

Government forces also shelled houses in Taiz ? a hotbed of anti-Saleh protests ? killing five people, including four members of one family, a local official said. All officials spoke on condition of anonymity because they were not authorized to speak to the media.

Saleh has clung to power in the face of more than eight months of massive near-daily protests against his rule.

As they burned their veils, Yemeni women activists handed out leaflets appealing for help and protection.

"This is a plea from the free women of Yemen; here we burn our makrama in front of the world to witness the bloody massacres carried by the tyrant Saleh," the leaflets read.

Across town, a group of women supporters of Saleh marched Wednesday up to the U.N. office to voice their opposition to international pressure on the president to step down. The women entered the U.N. building to hand in their protest note.

During a meeting with the U.S. ambassador on Tuesday, Saleh offered to sign a U.S. and Gulf Arab-backed power transfer deal that gives him immunity from prosecution if he steps down.

The meeting with U.S. Ambassador Gerald Feierstein was Saleh's first since he returned last month from Saudi Arabia, where he was treated after an attack on his presidential compound in June left him badly wounded.

Saleh has repeatedly backed out of the deal at the last minute and the opposition has dismissed his latest offer.

In Washington, State Department spokeswoman Victoria Nuland expressed disappointment over lack of progress, despite Saleh's pledge to sign the power transfer accord.

"We said that the proof would be in the pudding," Nuland said. "We haven't yet tasted a good pudding."

AP NewsBreak: College athletes press NCAA reform

More than 300 football and men's basketball players from Arizona, Georgia Tech, Kentucky, Purdue and UCLA want the NCAA and college presidents to set aside a cut of TV sports revenue for student-athletes to cover the cost of their education.

A petition signed by the players asks the NCAA to "realize its mission to educate and protect us with integrity." The National College Players Association, an athletes' advocacy group, provided The Associated Press with copies of the document for release on Monday. Players started sending the petition to the NCAA last week.

The issue of whether to pay college athletes has been getting increased attention at a time when major college football programs from Miami to Ohio State have endured scandals involving impermissible benefits to players. At the same time, athletic conferences have made lucrative, new television deals.

Before now, athletes themselves had not voiced their opinions in such numbers.

Boeing Dreamliner to hit the skies with first passengers (Reuters)

TOKYO (Reuters) ? The Boeing Co (BA.N) 787 Dreamliner takes its first paying passengers aloft on Wednesday, showing off a carbon-composite design its maker says is lighter, more economical to fly and more comfortable than its metal rivals currently plying the airways.

The special charter flight by the twin-engined jet from Tokyo to Hong Kong comes after years of delays as Boeing engineers had to deal with glitches and parts delays, leaving some $16 billion of inventory at Boeing's plants.

The first flight will not get its passengers to their destination any sooner than rivals. Boeing's technological flagship is little faster than the 707, the first commercial jet it built more than half a century ago.

Yet the first owner of the 787, All Nippon Airways Co (9202.T), is just fine with the idea of delivering its passengers in same amount of time they always have. Instead, it wants to get them there cheaper and happier, a formula that other carriers see as the key to surviving in a cutthroat global air travel market rattled by the rise of budget carriers.

"For carriers with high operating margins, the 787 is critical for gaining a cost competitiveness," said Masaharu Hirokane, an analyst at Nomura Holding in Tokyo. "For ANA to be a launch customer is a plus," he added.

The Dreamliner was originally conceived in 2001 as the "Sonic Cruiser," designed for a bygone era of aviation that quickly morphed into one filled with bankruptcies and soaring fuel costs. It was a design that promised the first serious speed increase since the advent of the now defunct Concorde.

Most jetliners cruise at around eight-tenths the speed of sound. The Sonic Cruiser promised mach 0.98, lopping hours off long-haul flights between Tokyo and New York. The apparent end of cheap oil, with prices close to $100 a barrel, forced Boeing and other airlines to change course.

Thus was born the Dreamliner. With Boeing's rival, Airbus (EAD.PA), also focused on lowering its cost-per-passenger mile, the prospects for more speed any time soon are dim.

COMFORTABLE WITH PRODUCTION TARGET

Scott Francher, Boeing's head of the 787 program, said on Wednesday that the company is comfortable with the production targets for its 787 Dreamliner. The company hopes to build 10 per month by 2013.

"We are comfortable we have an executable plan," Francher told reporters in Tokyo ahead of the plane's first flight.

With its mostly carbon-composite body, Boeing's technological flagship offers a 20 percent improvement in fuel efficiency. Its cabin builders promise a flight with ambient lighting engineered to lull passengers to sleep and higher air pressure that will make the interior feel like 6,000 feet rather than the 8,000 feet passengers feel on other jetliners.

The aircraft's success or failure will depend much on Japan, the only major aviation market where Boeing clearly dominates its European rival.

More than a third of the Dreamliner is built by Japanese companies, including Mitsubishi Heavy Industries (7011.T), Kawasaki Heavy Industries (7012.T) and Fuji Heavy Industries (7270.T).

Of Boeing's backlog of 821 orders for the Dreamliner, nearly a tenth of them are from Japan.

ANA expects its 55 aircraft by March 2018 and has so far stuck with Boeing despite three years of delays. That is a welcome commitment for Boeing after China Eastern Airlines (600115.SS) on October 17 terminated an order for 24 Dreamliners rather than wait for production to pick up speed.

Air New Zealand (AIR.NZ) voiced concerns over possible further delays last week. The carrier said it is seeking compensation from Boeing.

The plane builder on September 26 said it expects to break-even on the plane this decade. Boeing releases its latest earnings results in the United States on Wednesday.

Enthusiasm in Japan for Boeing has been undimmed by the delayed Dreamliner.

The 100 seats available to paying passengers on the flight sold out as soon as they went on sale, with 25,505 people scrambling online for the scarce tickets. A pair of tickets that ANA offered on the Yahoo auction site for charity sold for 890,000 yen ($11,693.601).

Feds fight producer's bid to overturn extradition (AP)

LOS ANGELES ? Federal prosecutors are asking a judge to reject a reality TV producer's petition to overturn an extradition order on allegations that he killed his wife during a vacation in Mexico.

The filing Monday by prosecutors in Los Angeles argues that attorneys for ex-"Survivor" producer Bruce Beresford-Redman haven't presented credible conflicting evidence that would warrant overturning the order authorizing his return to Cancun to stand trial.

Beresford-Redman filed a brief in September arguing that the magistrate judge's extradition ruling didn't take into account evidence favorable to him. He was charged with aggravated homicide after his wife Monica was found dead at an upscale resort in April 2010.

The latest filing says the judge considered evidence presented by Beresford-Redman, but didn't find it compelling.

Egypt court delays hearing on request to drop Mubarak panel (Reuters)

CAIRO (Reuters) ? An Egyptian court postponed hearing a demand to change the panel presiding over a case against ousted President Hosni Mubarak until December, potentially delaying the trial into whether he was responsible for the deaths of hundreds of demonstrators.

Some of the lawyers representing families of those killed in an uprising against Mubarak's rule have demanded changes to the panel after complaining that it had failed to give them adequate time to question a key witness.

They said that Field Marshal Mohamed Hussein Tantawi, who heads the army council now ruling Egypt, gave testimony at an earlier time than scheduled and had not been cross-examined by them.

The appeals court on Saturday adjourned its hearing until December 26, saying it needed to review Judge Ahmed Refaat's record and background, specifically requesting details of any consultancy positions he was involved in.

Egyptian judges are often used by government ministries or bodies, a practice that critics say has often brought the objectivity of some judges into doubt.

Judge Refaat has a reputation of working by the book and following procedures. He has been praised for his independence by the media.

The court had previously requested the minutes of Mubarak's trial to check the "legality of the court's proceedings."

Mubarak's trial is on hold until October 30, but the case is unlikely to resume until a verdict on changing the panel is issued, a delay that will add to public frustration over the pace of the trial.

NASA sting terrifies elderly woman

The elaborate mission to recover a moon rock led NASA agents to one of the most down-to-earth places: a Denny's restaurant in Riverside County.

But at the end of the sting operation, agents were left holding a speck of lunar dust smaller than a grain of rice and a 74-year-old suspect who was terrified by armed officials.

Five months after NASA investigators and local agents swooped into the restaurant and hailed their operation as a cautionary tale for anyone trying to sell national treasure, no charges have been filed, NASA isn't talking and the case appears stalled.

The target, Joann Davis, a grandmother who says she was trying to raise money for her sick son, asserts the lunar material was rightfully hers, having been given to her space-engineer husband by Neil Armstrong in the 1970s.

"It's a very upsetting thing," Davis told The Associated Press. "It's very detrimental, very humiliating, all of it a lie."

The strange case centers on a speck of authenticated moon rock encased in an acrylic-looking dome that appears to be a paperweight. For years, NASA has gone after anyone selling lunar material gathered on the Apollo missions because it is considered government property, so cannot be sold for profit.

Still, NASA has given hundreds of lunar samples to nations, states and high-profile individuals but only on the understanding they remain government property. NASA's inspector general works to arrest anyone trying to sell them.

The case was triggered by Davis herself, according to a search warrant affidavit written by Norman Conley, an agent for the inspector general.

She emailed a NASA contractor May 10 trying to find a buyer for the rock, as well as a nickel-sized piece of the heat shield that protected the Apollo 11 space capsule as it returned to earth from the first successful manned mission to the moon in 1969.

"I've been searching the internet for months attempting to find a buyer," Davis wrote. "If you have any thoughts as to how I can proceed with the sale of these two items, please call."

Davis told AP the items were among many of the space-related heirlooms her husband left her when he died in 1986. She said she had worked as a lexicographer and he had worked as an engineer for North American Rockwell, which contracted for NASA during the Apollo era.

Davis claims Armstrong gave the items to her husband, though the affidavit says the first man on the moon has previously told investigators he never gave or sold lunar material to anyone.

In follow-up phone conversations with a NASA agent, Davis acknowledged the rock was not sellable on the open market and fretted about an agent knocking on her door and taking the material, which she was willing to sell for "big money underground."

"She must know that this is a questionable transaction because she used the term 'black market,'" Agent Conley states in the search warrant.

Curiously, though, Davis agreed to sell the sample to NASA for a stellar $1.7 million. She said she wanted to leave her three children an inheritance and take care of her sick son.

NASA investigators then arranged the sting, where Conley met with Davis and her current husband at the Denny's at Lake Elsinore in Riverside County.

Soon after settling into a booth, Davis said, she pulled out the moon sample and about half a dozen sheriff's deputies and NASA investigators rushed into the eatery.

When officers in flack vests took a hold of her, the 4-foot-11 woman said she was so scared she lost control of her bladder and was taken outside to a parking lot, where she was questioned and detained for about two hours.

"They grabbed me and pulled me out of the booth," Davis claimed. "I had very, very deep bruises on my left side."

Conley declined to comment and NASA Office of the Inspector General spokeswoman Renee Juhans said she could not talk about an ongoing investigation.

Davis was eventually allowed home, without the moon rock, and was never booked into a police station or charged.

The affidavit states authorities believed Davis was in possession of stolen government property but so far they have not publicly revealed any proof.

"This (is) abhorrent behavior by the federal government to steal something from a retiree that was given to her," said Davis's attorney, Peter Schlueter, who is planning legal action.

Joseph Gutheinz, a University of Phoenix instructor and former NASA investigator who has spent years tracking down missing moon rocks, said prosecuting Davis could prove tricky.

Gutheinz said he recently learned that NASA did not always take good care of lunar materials. In some instances, space suits were simply hosed off and any moon dust on them lost forever.

While bigger rocks, such as those given to various countries and museums were carefully inventoried and tracked, it now appears there are unknown numbers of much smaller pieces circulating in the public. Some of these may have been turned into paperweights and informally given away by NASA engineers.

"I have a real moral problem with what's happened here in California," Gutheinz said. "I've always taken the position that no one should own an Apollo-era moon rock. They belong to the people. But if we did such a poor job of safeguarding (lunar samples,) I cannot fault that person."

About 2,200 samples of lunar rocks, core samples, pebbles, sand and dust ? weighing about 840 pounds ? were brought to Earth by NASA's Apollo lunar landing missions from 1969 to 1972. A recent count showed 10 states and more than 90 countries could not account for their shares of the gray rocks.

As if it weren't hard enough keeping your house safe from debt collectors these days, now you have something else to worry about: a falling German satellite called ROSAT. The German Aerospace Center has estimated that the hunk of decommissioned, extra-orbital metal will enter the atmosphere sometime between 7:30pm ET tonight and 1:30am ET tomorrow. It's unknown whether any of the thing will survive re-entry, but the 1.7 ton telescope mirror onboard very well may, striking the surface at a hasty 17,398MPH. The agency doesn't know where it will fall, but did reassuringly say that it won't hit Europe -- German scientists basically telling the rest of the world to spend all night worrying while they doze away, peacefully. At least it won't be taking any of its orbital brethren with it...

Update: Looks like it landed in the Indian Ocean on Saturday night.

Sergio Garcia wins Castello Masters by 11 strokes

(AP) ? Sergio Garcia won his first title in almost three years on Sunday, dominating for the third straight day at the Castello Masters while earning an 11-stroke victory that matched the third-largest margin of victory in European Tour history.

The 31-year-old Garcia, playing on a course where he was club champion at the age of 12, shot an 8-under 63 in the final round to finish at 27-under 257.

"That was for Seve," Garcia said, referring to golfing great Seve Ballesteros, who died of brain cancer in May.

Garcia had shot his best ever back-to-back rounds of 63 and 64 to lead the field since Friday, and he did not let up on the final day, recording nine birdies and just his fourth bogey in the event.

"It's hard to say that you expect to fire like I did, but I was feeling good and I've been improving all year," Garcia said.

"At the beginning of the week there's always a little extra pressure because you want to do well in front of your home fans and on your home course. But I felt really good and it showed."

Fellow Spaniard Gonzalo Fernandez-Castano finished a distant second, and Alexander Noren was third.

Once ranked No. 2, Garcia had dropped outside the top 75 after near-misses at the 2007 British Open at Carnoustie and 2008 PGA Championship at Oakland Hills.

He has now returned to the top 35 with his second win at the Club de Campo del Mediterraneo, capping his improved season that includes top-12 finishes in the last three majors.

"I would like to thank not only my family and friends, but also my sponsors, everyone that's around me, for supporting me through two tough years," Garcia said. "They have stuck with me and believed in me and I'm happy to be able to pay them back with this victory."
